Your privacy is important to us. At Booster we are committed to handling your personal information carefully and in accordance with the Privacy Act 2020.

This privacy statement explains how companies within the Booster Group (“Booster,” we,” “our” or “us”) (which includes Booster Group Limited, and Booster Financial Services Group Limited and any of its subsidiary companies*) collects, uses, discloses and stores your personal information. It applies to any personal information we hold about you whether it was provided directly by you or a third party and includes information in any form, such as paper, electronically or verbally.

When you provide your personal information to Booster, you agree we can use it as set out in this statement. When you apply for a product, service or a withdrawal, if you provide us with personal information about another person, you confirm:

  • you have notified the other person that you are providing their personal information to Booster and you have shared a copy of this Privacy Statement with them and
  • that person has explicitly consented to you providing their personal information to us and they understand their information will be used and managed in accordance with this statement.

We may make enquiries with third parties about any information you provide to us to check the accuracy of that information.

You can choose not to share your personal information with us, but this may affect the products and services we can offer you.


What is personal information?

Personal information is any information that could identify an individual person. Personal information includes information like your name, date of birth, address, financial information, gender, tax number, health and/or medical information, occupation, pastimes, income or any other information unique to you.


Collection of your personal information

The Privacy Act 2020 allows Booster to collect information if the collection is for a lawful purpose connected with an activity of Booster and the information is necessary for that purpose.

When you provide us with your information or your personal information is provided to us, you agree that Booster (and any third-party provider to Booster) can collect, store, obtain and/or disclose your personal information directly to/from any relevant third-party professional for the purposes explained below. 


The types of personal information we collect

The information we collect about you and any other person depends on the product you apply for or the service you use and how you interact with us. Usually, we collect information such as general identification and contact information, but we can also collect biometric information (with your consent), financial, tax or employment information, usage information (such as IP address, device, browser, details of your operating system and activity) and any publicly available information about you.

For some applications we will need to collect sensitive information – for example, insurance applications may require information about your health, family medical history, pastimes, and occupation, whereas financial information may need to be provided for some applications for KiwiSaver withdrawals.


How we collect your personal information

We usually collect personal information directly from you. This happens when you apply for one of our products and/or services; request information; use our digital tools or website or when you communicate with us.

We may collect personal information about you from other parties such as a financial advice provider, or any other person who you authorise to represent you. If you have an insurance product with Booster, we may collect personal information from health professionals you consult with, or an insurance and/or reinsurance company. We only collect your information from third parties if you’ve agreed to it and we reasonably believe it’s necessary for us to provide our products or services, or if required by law.

We may also collect information from our clients about other people who we have no direct business relationship with. If this occurs, and we require the other person’s personal information to support an application made by our client, the other person’s personal information will be subject to the same standards of use, disclosure, and protection as set out in this statement. The other person also has the same rights to access and request correction of their personal information.

We generally record phone calls for training and quality assurance purposes. As well as audio recordings we may also store the time, date, duration, and phone number associated with a call.

We may also use CCTV cameras to record footage at our offices for security and safety purposes. Recorded footage may constitute personal information under the Privacy Act 2020. Signage advising of such equipment will give notice of the areas covered.


How and why we use your personal information

We use the information we collect about you in the way described in this statement, or as prescribed by New Zealand law. We may use your personal information to:

  • Verify your identity or address information.
  • Administer and assess your application for a product or service, an insurance claim or a withdrawal.
  • Provide, evaluate, and improve our products and services.
  • Administer and manage your account(s), including responding to communications from you including requests, instructions, queries, and complaints.
  • Communicate with you to ensure you have products and services that meet your needs, and to advise you of any changes to existing products and/or services, or to conduct surveys.
  • Contact or market to you, including through social media.
  • Conduct market research, data processing and statistical analysis activities.
  • Protect and enforce our rights as part of our relationship with you.
  • Consider any application, enquiry or engagement relating to employment or other commercial relationship with Booster.
  • Comply with laws, rules, regulations and Codes of practice (including, but not limited to, the KiwiSaver Act 2006, the Financial Markets Conduct Act 2014, the Tax Administration Act 1994 and the Anti-Money Laundering and Countering Financing of Terrorism Act 2009).
  • Report or respond to enquiries from regulator(s), government or law enforcement agencies or the Supervisor of our schemes.
  • Detect, deter, prevent or investigate fraud or other suspected criminal activity.
  • Ensure the safety and security of our staff, contractors, visitors and property.

Marketing

We may also use your personal information for marketing purposes to send you information about products or services we think may be of interest to you. This may involve disclosing your personal information such as your name and contact details (but not sensitive information) with our service providers. We have strict confidentiality agreements with the service providers we use for this purpose. If you prefer not to receive information about other products or services we offer, please let us know.


Who we share your personal information with

We may share your personal information with third parties if necessary for the purposes described in this privacy statement, or when required by law.

With your agreement we may share your personal information with your financial adviser. This may include answers to health and lifestyle questions in an application form for insurance cover, or payment of a policy claim. If you agree that we can disclose personal information relevant to the financial products you hold to your adviser, we will not treat that as consent to disclose information relevant to any insurance product you hold unless you provide additional consent.

By providing us with your personal information, you agree we can disclose your information to third parties, including but not limited to:

  • Our related organisations who need the information to assist with the purposes listed above.
  • Any person in New Zealand who provides services to or for us for the purposes listed above (including any medical specialists that we may refer to for insurance underwriting or claims purposes).
  • Any overseas organisation that provides services to or for us for the purposes listed above.
  • Organisations that provide credit reporting or debt recovery services.
  • Organisations we outsource customer care or information technology services to.
  • Organisations which provide us with research, analysis, or other related services.
  • Organisations which provide us with marketing services or electronic platforms to enable us to communicate with you.
  • In the event of your incapacity or death, the holder of your enduring power of attorney, the executor or administrator of your estate or the Policy Owner of a Policy where you are the Life Insured.
  • The Supervisor of our schemes.
  • Government regulatory agencies or law enforcement agencies as permitted or required by law or where the disclosure of that information is necessary to avoid prejudice to the maintenance of the law, including prejudice to the prevention, detection, investigation, prosecution, and punishment of offences.

If we disclose personal information to any third party outside New Zealand, we take reasonable steps to ensure the third party is subject to privacy laws which provide comparable safeguards to those under the New Zealand Privacy Act 2020 or are required to protect personal information in a way that provides comparable safeguards to those under the Privacy Act.


How we protect your personal information

We take reasonable steps to keep your personal information secure, by implementing reasonable IT system security measures, staff training and physical security controls.

We also require our third party service providers (who hold personal information on our behalf) to ensure they have reasonable security measures in place to protect the personal information in their possession or control, including our cloud-based storage providers who store data in New Zealand or overseas


Accessing and correcting your personal information

Access

You have the right to access any personal information we hold about you. To request copies of your information, please contact us via our details below. We will determine whether you are able to access the information.

Under the Privacy Act we have 20 working days to respond to your request. This timeframe can be extended in certain circumstances such as if we need more time to collate and send a copy of the information to you or we need to consult with our advisers on whether we can release the information. If we require an extension to the timeframe we will advise you within 20 working days.

We may deny requests to access personal information in certain circumstance, such as where the information is legally privileged or commercially sensitive. If we decide to withhold information, we will explain why we are refusing your request. You are entitled to challenge our decision and can make a formal complaint to the Privacy Commissioner.

We can charge a reasonable fee to cover the costs of processing your request for information. However, we would only do so in exceptional circumstances, and we would let you know before processing your request.

Correction

You can ask us to correct any information we hold about you if you consider that information is inaccurate. You can do this by contacting us via our details below.

If we are unable to correct your information, we will advise you of the reason why and of your right to request that we attach your request to the information as a ‘statement of correction’.


Changes to this Statement

We may change this statement from time to time, and the latest version will always be available on our website.

You should check this statement regularly so you are aware of any updates. Your continued use of our products, services, websites and tools will be treated as your acceptance of the updated statement. We may also take additional steps to bring any changes to your attention, including by notifying you directly.

If any application form or other document or communication issued by us refers to our “Privacy Policy” it should be understood as a reference to this Privacy Statement.

Cookies

When using our website, ‘cookies’ are used to collect anonymous online web traffic data and track movements of webs users. We use this data to understand how you use our website and how we can make your online experience with us more enjoyable.

Commonly used by modern websites a “cookie” is a small file sent to your computer. Cookies identify your computer; they do not record any personal information and are not used to identify you. Cookies cannot carry viruses and cannot be programmed. If you don’t want to receive cookies from us, you can set your browser to alert you of a cookie being offered, or to reject all cookies. However, this will affect the usability and functioning of the website.
